1. Acceptance of Terms
By accessing and using freemail99.cloud (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services. Any participation in this service will constitute acceptance of this agreement.
2. Service Description
The service is provided "as is" and the provider assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings.
3. User Conduct
You agree not to use the Service to:
- upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
- harm minors in any way;
- impersonate any person or entity, including, but not limited to, a freemail99.cloud official, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;
4. Disclaimer of Warranties
You expressly understand and agree that your use of the service is at your sole risk. The service is provided on an "as is" and "as available" basis. freemail99.cloud and its subsidiaries, affiliates, officers, employees, agents, partners and licensors expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
5. Limitation of Liability
You expressly understand and agree that freemail99.cloud and its subsidiaries, affiliates, officers, employees, agents, partners and licensors shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if freemail99.cloud has been advised of the possibility of such damages), resulting from the use or the inability to use the service.
6. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Netherlands, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to these terms shall be filed only in the courts located in the Netherlands and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.
7. General Information
This service is operated from Liechtenstein. The failure of freemail99.cloud to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. If any provision of the Terms of Service is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms of Service remain in full force and effect.
